From the opposite perspective, a pioneer may spend up to billion on research and development "R&D" ; for a new drug.96 Further, the FDA only approves about 0.02% of the drugs that pioneers begin to research and develop.97 By contrast, the cost to a generic of "establishing bioequivalence" in an ANDA is "on the order of million."98 Further, decisions in patent cases may be highly unpredictable, leading to uncertainty regarding litigation even if the pioneer strongly believes its patents are valid. If a pioneer cannot protect its patents, it may not pursue R&D on as many drugs or on drugs with smaller markets that may not yield the highest profits. Society benefits from pioneers researching a broad range of drugs that provide benefits to patients with varied medical conditions. If a drug company fears it will never recoup R&D costs because of generic entry, it will focus on a small number of drugs with a high profit margin. While this does not mean that a pioneer should be able to file frivolous patents or enjoy blanket immunity from antitrust liability, it does mean that a bright-line rule prohibiting such settlements may not provide the greatest benefit to the public at large.
